What is the Purchase Protection Plan?

While you are a Podium™ member, all of your eligible purchases will be covered by the Purchase Protection Plan. If your purchases are stolen or damaged in an accident, we will replace your products for free. The Purchase Protection Plan only covers above mentioned product categories purchased from BikeBandit.com and does not cover parts, tires, accessories, tools or manuals. Members must submit a copy of the police report to BikeBandit.com from their incident to be eligible for a replacement product, along with the damaged item if there was an accident. BikeBandit.com will replace the stolen or damaged product with the exact product if it is still available. If the product is not available, you will receive a BikeBandit.com gift card for the original purchase price.

Why do I need a police report to use the Purchase Protection Plan?

Unfortunately, people like to take advantage of free stuff. A police report would be available if you were in an accident or if your stuff was stolen and is one of the easiest way for BikeBandit.com to verify your terrible tragedy. All eligible purchases damaged or stolen must be itemized on a police report. If the items were damaged, they need to be shipped back to Bikebandit.com for inspection. If the items were stolen, returning the items will not be required, but you will need to send BikeBandit.com a valid and legible copy of a police report itemizing the stolen riding apparel in order to process your request for new gear. We understand that not all accidents are reported to the police, but BikeBandit.com needs a police report in order to replace the item.

Purchase Protection Plan
Terms & Conditions

This is a legal contract (hereinafter referred to as the "Plan"). By purchasing it, you understand that it is a legal contract and acknowledge that you have had the opportunity to read the terms and conditions set forth herein. Definitions: Throughout this Plan the words "we", "us" and "our" refer to BikeBandit.com The words "you" and "your" refers to the purchaser of this Plan.

A. Purchase Protection Plan - Plan Coverage.
»The plan is an extra benefit given to BikeBandit.com Podium™ members. The plan allows you, the user, to receive a replacement item if you purchased that item from BikeBandit.com while you are a Podium™ member. You are eligible to receive a replacement for your purchased item if:
1. Your apparel is stolen
OR
2. Your apparel is damaged in an accident

» In order to receive a replacement item, you must submit a police report from the robbery (if stolen) or the accident. If you were in an accident, you also need to return the damaged item for verification.

» Your coverage under this Program is effective beginning on the date you purchase your eligible items and will expire either one (1) year from this effective date or the when your Podium™ membership expires, whichever comes first.

» This Program is inclusive of your product's manufacturer's warranty; it does not replace your product's manufacturer's warranty, but it does provide certain additional benefits as listed within this Program during the term of the manufacturer's warranty.

» This plan does not replace or negate BuySafe's guarantee of your purchase. BuySafe is a separate entity and not involved in this contract.

B. Eligible Purchases
» The Program only applies to certain items from BikeBandit.com. The following product categories are covered by the Program (as classified by the navigation on BikeBandit.com):
      1) Helmets, 2) Jackets, 3) Vests, 4) Pants, 5) Gloves, 6) Boots, 7) And Portective Gear.
» The preceding product categories are the only products covered in this Program, no exceptions. The Program does not cover parts, tires, accessories, tools, manuals, or any other products not mentioned in the above list. We reserve the right to exclude any products in the future.
» If you have any questions about which items are covered under the Plan, please contact Customer Service at 1-888-339-3888.

» Products that are covered under the manufacturer's warranty during the manufacturer's warranty period or that are the subject of a manufacturer's recall are the responsibility of the manufacturer and are not covered under this Program. The Program in no way validates or endorses any claims stated or implied in the manufacturer warranty of any products.
» For your items to be eligible for the plan, you must be Podium™ member at the time of the purchase. Your eligible items are protected under the plan for one (1) year or until your Podium™ membership expires, whichever comes first.

C. Replacement of Purchases
» If your purchases have been damaged in an accident or stolen you must:

  • Obtain a police report that states what happened in your accident OR an itemized list what was stolen (if that is the case)
  •    We understand that not all accidents are reported to the police. However, BikeBandit.com needs a police report in order to reimburse your purchase.
  • Contact Customer Service to obtain a Return Request and Refund Request
  • Send back the damaged merchandise (if in an accident)
» A copy of the police report is needed in order to verify stolen or damaged products. If no police report is received, no reimbursement will be given. All items being claimed for reimbursement must be explicitly itemized on the police report, including type (e.g. helmet, jacket, pants, etc.), brand, color and size.

» We will replace your damaged or stolen item with the exact same product if it is still available. If the same product is no longer available, we will issue you a BikeBandit.com gift card for the amount of the original purchase.

» Technological advances may result in a replacement product with a lower selling price than the original product.

» Our obligations under the Program will be fulfilled in their entirety if we replace your product with a new or refurbished product or issue you a voucher or gift card for replacement value of your product pursuant to these terms and conditions.

» Your replacement product will be covered under the Program for the remainder of the original terms, i.e. 1 year from the original product's purchase date or until the termination of your Podium™ membership, whichever comes first.

D. Insurance Securing this Plan.
» This Program is not a contract of insurance, but simply a benefit offered by BikeBandit.com for joining BikeBandit.com Podium™.

What information is required to join Podium™?

In order to join Podium, access your Podium™ membership benefits and have them applied to your online orders, you'll need to create a BikeBandit.com account. This requires an email address, password and mailing address. If you already have an account, you can sign in and use your existing account to complete your Podium™ purchase.

Please note, Podium™ will use your current billing and shipping address for verification. Please make sure they are accurately saved within your account. Your shipping address will be used to verify you live in the 48 contiguous states. Cycle World will process and send your first issue of your 1- year subscription to your current shipping address. Can I cancel my membership and get a refund?

We're sorry – Since Podium™ membership benefits are available immediately, Podium™ membership costs are not refundable. Please note that your Podium™ membership will expire 12 months after your purchase date and will not be renewed automatically. You can cancel Podium™ at any time, but refunds will not be given at any time.

Can I purchase a BikeBandit.com Podium™ membership if I live outside the United States?

No. We do not allow the purchase of a BikeBandit.com Podium™ membership by international customers at this time. Only U.S. Residents who live in the 48 contiguous states are eligible to purchase a membership. That means Alaska and Hawaii customers are also excluded.

Why didn't my item/order qualify for Podium™ membership shipping rates?

We're sorry, we do not offer shipping benefits to Alaska, Hawaii or any other country besides the United States. Also, some very large or heavy items may be excluded or require additional shipping and handling charges.

Yes. To change your Podium™ membership email address, you'll need to change the email address that is associated with your BikeBandit.com account. Welcome to the Terms and Conditions for BikeBandit.com Podium™ ("Podium™"). These Terms and Conditions govern Podium™, which is brought to you by BikeBandit.com, (collectively, "BikeBandit.com", "we" or "us"). Your use of the BikeBandit.com website and your membership in Podium™ are also subject to our website Terms and Conditions and our Privacy Policy. Your membership in Podium™ subjects you to these Terms and Conditions; please review these Terms and Conditions carefully.

1. MEMBERSHIP BENEFITS
Your Podium™ membership entitles you (the "Member") to free ground shipping on eligible purchases and a $10 discount on express shipping to the 48 contiguous states. There is no minimum purchase requirement.

Members of Podium™ will receive a one-year subscription to Cycle World included in their membership. The regular subscription price for a one-year subscription to Cycle World is $ 15.00. This benefit will be sent out 4-6 weeks after joining Podium™.

Joining the Podium™ Program also enrolls you in our Purchase Protection Plan, which applies to the following product groups purchased from BikeBandit.com:
      1) Helmets, 2) Jackets, 3) Vests, 4) Pants, 5) Gloves, 6) Boots, 7) And Protective Gear.

In addition, we may offer periodic member-specific promotions, which we will notify you about via email to your email address that you provide to us.

Most items are shipped from our warehouse by UPS to arrive within five business days from our receipt of your order; however, we cannot guarantee delivery dates.

For any Podium™ benefits to apply, your Podium™ membership account must be active at the time of purchase. There will be no retroactive reimbursements for purchases made without an active Podium™ membership account.

2. Podium™ MEMBERSHIP CONDITIONS
Receipt of Podium™ membership benefits is limited to active Podium™ membership account holders. We reserve the right to accept or refuse Podium™ membership applications at our discretion.

Members must submit and maintain accurate and current user information in connection with their Podium™ memberships, including name, address, email address, and telephone number. Members must be age 18 or older. Members can change their account information by (i) updating member profile data through their www.BikeBandit.com account, or (ii) calling Customer Service at 1-888-339-3888.

Members may not use their Podium™ memberships for purchases made for the purpose of resale. Dealers are not eligible to become Podium™ members. No discounts will be given on the Podium™ membership fee.

Podium™ memberships are for individual use only and are non-transferable or assignable.

Dealers are not eligible to become Podium™ Members.

3. Podium™ MEMBERSHIP FEE
The annual Podium™ membership fee is currently an introductory rate of $29.95. We may change the Podium™ membership fee at any time, but changes will apply only to new and renewal Podium™ memberships. The fee is not refundable. No discounts will be given on the fee for Podium™ at any time. No sales tax will be charged for Podium™.

4. Podium™ MEMBERSHIP TERM; RENEWAL
The term of BikeBandit.com Podium™ shall commence on the date it is purchased and continue for one year unless earlier terminated according to these Terms and Conditions. You will be advised of your impending Podium™ membership expiration via email to the email address that you provide to us in advance of the expiration date. If you do not notify us of your decision to renew your Podium™ membership before the expiration date, your Podium™ membership will automatically be canceled on the expiration date.

5. CANCELLATION; TERMINATION
You can cancel you Podium™ membership at any time. However, due to the immediate benefits of Podium™, (full or partial) refunds are not given at any time.

We may terminate any or all of the benefits available under the Podium™ at any time with or without notice. If we terminate Podium™, at our option, we will either continue offering you your Podium™ membership benefits until the expiration of your Podium™ membership term, or we will refund you a pro rata portion of the Podium™ membership fee for the remaining portion of your Podium™ membership term.

In addition, BikeBandit.com may temporarily freeze and/or terminate your account if we suspect any abuse or fraudulent use of your Podium™ membership at our sole discretion. We will notify you in the event that we take any such action, and you will not be entitled to a refund of your Podium™ membership fee.

6. DISCLAIMERS; LIMITATION OF LIABILITY
USE OF THE PODIUM™ PROGRAM AND ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. BIKEBANDIT.COM AND ITS AFFILIATES, DIRECTORS, OFFICERS, AGENTS, EMPLOYEES OR OTHER REPRESENTATIVES (COLLECTIVELY "BIKEBANDIT.COM ") EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

IN NO EVENT WILL BIKEBANDIT.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO YOUR PODIUM™ MEMBERSHIP, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES.

THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR PODIUM™ MEMBERSHIP. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

7. GOVERNING LAW
These Terms and Conditions are governed by, and construed in accordance with, the laws of the State of California, without regard to conflict of law principles.

8. BINDING ARBITRATION
Any controversy or claim arising out of or relating to these Terms and Conditions (including any breach thereof) or the Podium™ Program shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules (including without limitation the Supplementary Procedures for Consumer-Related Disputes), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated with any claim or controversy of any other party. The foregoing shall not preclude BikeBandit.com from seeking any injunctive relief in State or Federal courts for protection of their respective intellectual property rights (including such rights of their respective licensors).

9. ACKNOWLEDGMENT
These Terms and Conditions and all documents referenced herein represent the entire understanding between BikeBandit.com and any user of the Podium™ Program. membership in the Podium™ Program is deemed to be acceptance of these Terms and Conditions.

10. CHANGES TO THESE TERMS AND CONDITIONS
We may change the terms of these Podium™ Program Terms and Conditions at any time without notice to you by posting revised Terms and Conditions at www.bikebandit.com. Any change shall take effect immediately, unless otherwise indicated. We may also increase the Podium™ membership fee at any time; however, any fee increase will not apply to your Podium™ membership until your Podium™ membership is renewed.

Your continued membership in the Podium™ Program after we change these Terms and Conditions constitutes your acceptance of any and all changes.
